1. Scope of Application
The following general terms and conditions (GTC) apply to all orders placed through our online shop by consumers and business customers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional in nature. A business customer is a natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.
These GTC also apply to future business relationships with business customers without us needing to refer to them again. If a business customer uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.
2. Contracting Party and Formation of Contract
The purchase contract is concluded with the Swiss Health & Nutrition AG.
By listing products in the online shop, we make a binding offer to conclude a contract for those items. You may initially add our products to your shopping cart on a non-binding basis and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive a confirmation by email.

3. Delivery Terms
Delivery is available worldwide. The General Shipping Policy. For details on shipping costs, please see here
Deliveries within the EU are dispatched from our warehouse in Höchst (Austria). No customs duties therefore apply.
Deliveries within the USA are dispatched from our warehouse in Switzerland. As of 29 August 2025, all shipments imported into the USA are subject to the new US customs regulations regardless of order value, and customs duties and charges apply with no minimum threshold.
Duties and charges are levied by the customs authorities of the destination country and, unless otherwise stated, are generally payable by the recipient. More information on the assumption of customs duties
Product prices are stated in the indicated currency and include VAT or sales tax. Exceptions apply to tax-exempt deliveries to delivery addresses outside Switzerland and the EU, as well as deliveries to companies outside Switzerland and Austria.
The minimum order value is CHF 05.00 (five Swiss francs).
Shipping costs are charged in addition to the stated product prices. Details on the applicable shipping costs can be found during the shopping cart checkout.
We deliver by post only. In-store pickup is available by prior arrangement only.
We do not deliver to parcel lockers.
The delivery time within Switzerland and Europe is 2–4 business days unless otherwise stated in the offer. For all other countries, the delivery time depends on local customs authorities. You will be notified if delivery cannot be made within the stated delivery time. No claims for damages may be derived from a delay in delivery.
If not all ordered products are in stock, the Swiss Health & Nutrition AG is entitled to make partial deliveries.
If delivery of the goods fails through the fault of the customer despite three delivery attempts, the Swiss Health & Nutrition AG may withdraw from the contract. Any payments already made will be refunded without delay.
All products offered are dispatched within their best-before date (BBD).
4. Payment
The following payment methods are available in our shop: credit card, Twint (Switzerland), purchase on account (Switzerland & Liechtenstein), advance payment (bank transfer), Google Pay (not available in all countries), Apple Pay (not available in all countries).
Purchase on account (including instalment payment) is processed by CembraPay AG. The Terms and Conditions and the Privacy Policy of CembraPay AG.
5. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal as described in the Cancellation Policy. No voluntary right of withdrawal is granted to business customers.
5.1 Exchange / Returns
The exchange and return of faultless products generally cannot be accommodated, in compliance with Swiss food law and the food safety standards that must be guaranteed. Exchanges or returns are only possible for defective products, within 7 days of receipt of the goods and following inspection of the defect, in accordance with Swiss legislation. Shipping costs for the exchange or any return of defective products will be covered.
6. Retention of Title
The goods remain our property until payment has been made in full.
The following additionally applies to business customers: We retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; all claims arising from such resale are hereby assigned to us in advance in the amount of the invoice total — regardless of whether the reserved goods have been combined or mixed with a new item — and we accept this assignment. You remain authorised to collect the claims; however, we may also collect claims ourselves to the extent that you fail to meet your payment obligations.
7. Subscriptions
When you purchase a subscription, you will receive recurring deliveries. These depend on the duration and frequency of the subscription you have selected. (Minimum term: 3 order cycles)
Your payment details will be stored securely, and each of these deliveries will be charged to you unless you choose to pay in advance.
Some subscriptions may renew automatically at the end of their term. If you do not wish to renew a subscription, you may cancel it.
If you wish to cancel or modify your subscription, you may do so at any time after the minimum term has elapsed. Your order confirmation emails contain links to your order, from which you can manage your subscription. You may also cancel your subscription after 3 order cycles in the "Subscriptions" section of your account.

8. Discounts
Discounts, vouchers, and other benefits generally cannot be combined with one another. It is not possible to redeem multiple discount codes, vouchers, or special offers simultaneously. This also applies in conjunction with subscriptions or other ongoing benefits. Unless specifically defined in the offer, the maximum validity period for discounts and vouchers is 365 days.
9. Damage in Transit
If goods are delivered with obvious transit damage, please report such defects to the delivery person as promptly as possible and contact us without delay. Failure to file a complaint or make contact has no bearing whatsoever on your statutory rights and their enforcement, in particular your warranty rights. However, you will be helping us to assert our own claims against the carrier or transport insurer.
10. Warranty and Guarantees
Unless expressly agreed otherwise below, the statutory liability for defects shall apply.
For consumers, the limitation period for claims arising from defects in used goods is one year from delivery of the goods. For food products and dietary supplements, the limitation period is likewise one year, but no longer than the expiry of the best-before date.
With respect to business customers, only our own specifications and the manufacturer's product descriptions incorporated into the contract shall constitute an agreement on the quality of the goods.
If the delivered goods are defective, we shall provide warranty to business customers initially at our discretion, either by remedying the defect (subsequent improvement) or by Delivery of a defect-free item (replacement Delivery).
The foregoing limitations and shortened time limits do not apply to claims arising from damages caused by us, our legal representatives, or vicarious agents:
- in cases of injury to life, body, or health
- in cases of wilful or grossly negligent breach of duty, as well as fraudulent intent
- in cases of breach of material contractual obligations whose fulfilment is essential to the proper performance of the contract and on whose observance the contracting party may regularly rely (cardinal obligations)
- within the scope of a guarantee commitment, to the extent agreed
- to the extent that the scope of the Product Liability Act is applicable.

11. Liability
We are always liable without limitation for claims arising from damages caused by us, our legal representatives, or vicarious agents:
- in cases of injury to life, body, or health
- in cases of wilful or grossly negligent breach of duty
- in cases of guarantee commitments, to the extent agreed
- to the extent that the scope of the Product Liability Act is applicable.
In cases of breach of material contractual obligations whose fulfilment is essential to the proper performance of the contract and on whose observance the contracting party may regularly rely (cardinal obligations), caused by slight negligence on our part or on the part of our legal representatives or vicarious agents, liability shall be limited in amount to the foreseeable damage at the time of conclusion of the contract that would typically be expected to arise.
Any further claims for damages are excluded.
We wish to draw explicit attention to the fact that, due to differing case law and interpretations by regulatory authorities in various countries, we cannot guarantee that our advertising copy complies with the applicable laws in every jurisdiction. Such copy is drafted to the best of our knowledge and belief; however, the publication of any wording on www.bethechange.swiss or in information leaflets is done entirely at the reader's own risk.
12. Final Provisions
Swiss law applies to debt collection. The place of jurisdiction is CH-9016 St. Gallen.
